Article 4: Rights and responsibilities of employer
Responsibilities: 
- Execute sufficiently essential conditions with full commitment under the Labor Contract
- Give the employee full and on time payment, policies and benefits under the Labor Contract, collective labor agreement (if any).
Rights: 
- Make the employee finish the tasks as per the contract (allocate, provisionally move, suspend)
- Temporarily postpone, terminate the contract, enforce discipline towards employees according to regulations of laws, collective labor agreement (if any) and the enterprise’s labor regulations.
Article 5: Executing term
- Matters relating to labor have not been written in this labor contract, we will apply regulations of collective agreement, in case there are no collective agreement, the labor code will be applied.
 - This Labor Contract is made into 02 copies of the same valuation. Each party will keep 01 copy. They will come into effect from 01/01/2012. When both parties sign labor contract appendix, the content of labor contract appendix is as valid as that of this contract.

INSTRUCTION ON HOW TO PREPARE LABOR CONTRACT
State in details name of company, enterprise, social organization, (ex: Ha Noi House Buiding Company)
Clearly state the occupation (if there are many occupations, mention the main), for example: engineer
State the type of Labor Contract: example 1: infinite term, example 2: 06 months
State clearly the main address, example: No. 2 – Dinh Le – Ha Noi; and substitute address (if any), example: No.5 Trang Thi – Ha Noi.
State main responsibilities such as installing, checking, fixing electrical system; ventilation system, cooling equipment, etc. in the company.
Specify the number of working hours in a day or a week, example: 08 hours/day or 40 hours/week
State the means of transportation assured by which Party, example: picked up by the company or self-supporting.
Clearly state salary according to salary scale or payroll applied, for example: salary scale A.1. Mechanics, electricity, electronics – informatics; Group III; Level 4/7; Coefficient 2,04; Salary amount when signing the contract is 428.400 dong/month.
State type of allowance, coefficient, allowance rate when signing the contract, for example: allowance for responsibility of Deputy Head of Department; Coefficient 0,3; Allowance rate 63.000 dong/month.
 For employee who is compulsory social insurance payer, specify the percentage of monthly salary that both parties shall pay to the social insurance agency. For example: Every month, the employer deducts 6% from the monthly payment of the employee and an amount in the equivalent payment to 17% of employee’s monthly salary to pay 20% to the social insurance agency and 3% to the health insurance agency.
For employee who is non-compulsory insurance payer, the amount for social insurance is added to the salary so that the employee pays redundant insurance or purchases any insurance by himself/ herself. For example: the amount of social insurance added to the employee’s salary is 17% of monthly salary.
 State if the Company sends someone to training programs, he/she shall bear any responsibilities or benefits. For example: During the training courses, the employee shall complete the courses on time, receives full payment and other benefits like people who are working normally, except for hazardous allowances.
State benefits that have not been in the Labor Code, nor collective labor agreement, but those are more beneficial for employee such as traveling, sightseeing, vacation, birthday gifts, etc.
Clearly state compensation rate for each violation, for example: after training, if the employee does not work for the company, he/she must compensate 06 (six) million dong; working time less than 02 years, compensate 03 (three) million dong.
